Commissions

If you're interested in a commission, There are a few methods set up;VGen: This is a platform specifically set up for commissions to be taken directly and easily, and allows for clients to leave reviews. Taking the commission process here helps me to be verified on this platform and let others know the experience clients receive from me.Commission Form: This is set up by myself for all necessary details to be sent immediately and directly for me to look over and respond to. Discussion is proceeded via email.Ko-Fi: This process is currently less streamlined than the others as my Ko-Fi's main focus is not commissions, but I have still opened them here if anyone finds it their most convenient option.Members of the Star Tier on my Ko-Fi membership receive a discount on their commissions - this is automatically applied if the commission is taken via Ko-Fi and I will calculate the discount if the commission is taken via Form or VGen.

Commissions

This Terms of Service Agreement is automatically bound to the client and the artist upon purchase of a commission. First-person references (I, Me, Myself) within these conditions refer to the artist of the commission transaction. Client will refer to the customer, or purchaser, of the transaction.This page may be edited from time to time. Ongoing commissions are not affected by adjusted or added terms, except in the case of fixing errors in text or phrasing.


1. GENERAL

  • The client must clearly provide their requirements upfront, including visual reference materials before work begins. Any missing details, regardless if left intentionally by the client, may result in artistic liberty (missing details decided by myself). Please provide as much as possible and be willing to communicate if you are seeking a precisely planned artwork.

  • By commissioning, the client accepts they are responsible for decisions and approval during the process.

  • I strive to perform in good faith and warrant all artwork is original to my best knowledge.

  • I reserve the right to refuse a commission, project or request within a commission for any reason.

  • I will provide progress and other updates directly through email or Ko-Fi messages, depending on which platform the client has contacted for a commission. I will not move platform of communication in the progress of a commission.

  • Please note I may take 1-2 business days to respond to commission submissions or any messages from clients. In the event of delays, deadlines or other time-sensetive information, I may take longer to ensure the client gets a clear answer.

  • I do not accept commissions through social media direct messages or on any public comments section, forum or chat; only through the methods I have set up and provided as shown on my Contact page to use when commissions are open.

  • Artist and client agree to discuss relevant matters concerning the project. Both parties have the right to decline unrelated topics of discussion.

  • Abusive, aggressive or other behaviour that proves intolerable to work with will result in prompt cancellation of the project and refusal to take work from the individual again.


2. CONTENT RESTRICTIONS

  • I will not create art that is explicit, offensive, inappropriate, or depict highly graphic or violent imagery.

  • Reference material provided by the client are also prohibited from containing the listed criteria and I will decline submissions that do not filter it out.


3. TURNAROUND AND PROCESS

  • Turnaround depends on commission type, complexity, and workload. The price variation of each listed commission option reflects the time needed to complete.

  • The client may ask for an estimated turnaround time ('ETA') but must understand this can be pushed back due to certain circumstances.

  • If there are any delays or adjustments to the ETA, I will inform the client.

  • I do not place a strict deadline upon a commission unless the client has prompted one with reason before the payment process.

  • I do not guarantee that the commissions taken earliest will be the first in a queue to be finished.

  • If the commission is custom and not a listed option, the ETA is likely to be less precise.

  • Should the client require this commission for their own projects, this should be acknowledged to me and the client must plan accordingly depending on time needed for the commission to be completed.

  • I will provide work-in-progress ('WIP') updates and seek feedback from the client. The client may request updates respectfully.

  • Final deliverables are provided via the platform communication has taken place between myself and the client. How the client may use their commissioned artwork is detailed in Section 5.

  • Clients must acknowledge and agree to delays and amendments to ETA exceeding 3 months.

  • Clients have the right to request refunds 3 months after deadlines as detailed by Section 7; if the artwork has not been delivered and there has been no further clarification or amendment to the ETA given by me.


4. REVISIONS

  • Revisions may affect progress and ETA.

  • During the sketch or outline of an artwork, major revisions from the client are allowed so long as it stays relevant to the previously provided prompts and reference material and comes to a gradual agreement from me and the client.

  • I am happy to accommodate for revisions, however if revision requests are continuous and commission consistency or progress is greatly lost due to repeated dissatisfaction from the client, I may cancel the commission.

  • After line art has begun, additional charges for excessive or large-scale revisions may be required.

  • Revisions required due to my own error or otherwise misinterpreted references and information that had already been given in a clear manner by the client are my full responsibility to acknowledge and make amendments to the artwork.

  • I allow any minor revisions by the client up to 7 days after the finished artwork has been provided. After this, revisions will be declined.

  • Clients may not edit the work after final delivery unless specified in the commission information, project outlines or otherwise approved by me.

  • Clients will receive a variant of their commission that includes a watermark which is strictly not to be removed. This variant is to be used when posting online or publicly.


5. RIGHTS AND USAGE

a. Artist General Rights

  • By default, I reserve the right to use a commission artwork for advertising and self promotion purposes, exempting when the work contains likeness, design, branding or other rights to the client or it has been requested and agreed upon that the commission stays private.

  • Cancelled, incomplete or otherwise abandoned commissioned artworks may be repurposed or resold. Anything of the client's property (eg. characters, branding) will not be used for these purposes. Elements of the posing, composition, visual effects, background and other features may be repurposed for another artwork or other visual material.

  • I reserve the right to sell merchandise and prints of their artwork, unless exclusive commercial rights are purchased by the client.


b. Client Rights for Personal Use Licensed Works:

  • By purchasing a commission, the client automatically receives a personal use license for their artwork. This is non-transferable and exclusive to the original client. Refer to Section 5.c. for commercial rights.

  • By personal use, this means the client is free to display their purchased artwork on their own social media, in online art galleries, online character archives and the like.

  • The client is free to display the artwork on broadcast platforms (eg. Youtube, Twitch) where it is not used directly for monetisation, sales or profit, such as a temporary display on a stream layout. However the client must acknowledge to me if they wish to use the commission for their broadcasting or other video-related projects as it may cross into the client’s branding or promotion and thus require a commercial fee.

  • The client may use, print, or crop their purchased artwork for private nonprofit use, such as social media banners, icons, backgrounds, physical art prints, or physical stickers. These are welcome so long as the watermark and/or signature on the artwork remains intact.

  • If the watermark and/or signature is cropped out due to positioning on social media icon or banner, the client does not need to move or reposition the art or the sake of the signature.

  • The client must not claim the work as their own and must credit me at the instance of posting the work via link/tag/username or on their websites, social media profiles, broadcast channels and so on where possible. Additionally, posts that can be shared or saved by others must be displaying the watermarked varient of the commission.

  • Crediting refers to linking to my Carrd page, my Ko-Fi page, any of my social media pages, or stating it is credited under the name jewelmoon.


c. Rights for Commercial Use and Royalties:This section applies specifically to clients that intend to use their commissioned artwork for profit or sales.

  • I must grant permission in written text before a client can use the artwork for their branding, promotion, merchandise, or other direct means of monetisation, sales and profit.

  • Commissions that fall into commercial use include but not limited to; logos, overlays, thumbnails and promotional assets for the client's videos, streams or other public projects; emotes and icons for subscriptions towards the client; artwork that the client intends to include in merchandise or sold goods.

  • Commercial use fees vary between projects. Please message me for a quote regarding your specific project.

  • Depending on the project, royalties may or may not apply. Royalty rate and applicability varies depending on the project type and client (corporation vs project team vs sole proprietorship).

  • Royalties may apply for merchandise or prints involving the artwork.

  • Clients may be eligible for a one-time license fee instead of a royalty rate for certain projects. This is an additional 30% of the project's cost and only needs to be paid once for the indefinite use.

  • Commercial use licenses are non-transferable and are exclusive to the original client.

  • Any use of my artwork relating to non fungible tokens, artificial intelligence generators (including the use as learning data), or cryptocurrency are strictly prohibited, regardless if for profit or not. I will not accept projects involving the listed criteria.


6. PAYMENT AND FEES

  • Client pays for the commission in full once the total is given. If arranged with me, the client may give partial payment in agreement that work does not start until payment is fully received.

  • Invoices or payment link will be sent to the client when I have overlooked your commission details and have accepted to add it to my queue. Clients must not send money before these requests for payment.

  • The project may be cancelled if invoices are not paid within 7 days. This does not apply if the client has made arrangements with me regarding their payment.

  • Prices are in GBP, and paid via PayPal invoice or payment processes provided by Ko-Fi or VGen, depending on which platform the client has contacted for submission.

  • Prices may rise depending on complexity, requirements and/or additional requests. The client chooses the details of the work aware potential increases may be required and agrees to them by accepting payment.

  • Once work has begun or payments have been made, the client acknowledges the artwork and deliverables are digital and there are no physically shipped goods to receive.

  • The client agrees that they will not issue chargebacks and the refund policy mentioned below will be followed.


7. CANCELLATION AND REFUNDS

  • If the client requests cancellation, a full refund may be provided if I am given notice before the work has started or before line art has started.

  • No refunds are possible once the sketch phase has passed and line art begins except for circumstances as detailed below and in Section 3.

  • If I cannot complete work or there are delays as detailed in Section 3 for unforeseen reasons, the client may be eligible for a partial to full refund depending on the amount of work complete and if the incomplete work is still accepted and used by the client.

  • If the commission comes to a cancellation, the client will be notified of the project's termination and amount of refund given (if applicable).


8. CONFIDENTIALITY

  • The Artist and Client acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information) shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.


9. ACCEPTANCE

  • Agreement date is upon first communication and is to be followed even if the project results in cancellation before full payment, completed artwork or a partial to full refund due to an unfinished artwork.

KO-FI SHOP

This Terms and Conditions Agreement is automatically bound to the buyer and the artist upon purchase of a commission. First-person references (I, Me, Myself) within these conditions refer to the artist who is also sole host of the Shop. Shop will refer to the page of which the merchandise listings are available. Buyer will refer to the customer, or purchaser, of the transaction.This page may be edited from time to time. Pending orders are not affected by adjusted or added terms, except in the case of fixing errors in text or phrasing.


1. GENERAL

  • Shop listings, the processing and delivery of all orders are entirely handled by one person. Patience is appreciated.

  • Buyers will be contacted in regards to orders being dispatched as well as any updates or delays to their order. If delays or other circumstances affect all orders or the Shop as a whole, this will be posted as an update on my Ko-Fi page.

  • Items on the Shop are kept up to date on details including availability. If a specific item is removed or out of stock, there are no guarantees on a restock.

  • Storage space for shop items is limited and restocks are dependent on continued interest and available storage.

  • I may accept special requests towards an order given via Ko-Fi direct messages (eg. It is a gift for someone else, the order is not to be dispatched until the buyer is back from holiday, etc). This is not to be used to request extra items for free or a reduced price.

  • I do not accept requests to hold stock for an order that has not been placed.

  • I do not accept payment or requests of order or purchase through social media direct messages or on any public comments section, forum or chat. Orders must be done directly through the Shop page itself.


2. SHIPPING PROCESS

  • Orders are sent out in bulk, meaning if several orders are confirmed over the course of a week or more depending on my availability, they are all sent out at the same time.

  • UK orders are sent out through First Class delivery and normally should arrive the next day (excluding Sundays).

  • International orders are sent out through International Tracking and upon the order being dispatched I will send the tracking number to the respective buyer. Depending on the destination country, the order can take 1 week to 1 month to arrive.

  • Orders are normally packaged and sent out 1-3 weeks after confirmation, but please give up to 2 months in the case of delayed shipment, unless I have specified a different delay time through either direct messages or Shop updates posted on my Ko-Fi page. Refer to Section 5 in regards to refunds.

  • Ensure that you buy all wanted items simultaneously - completing checkout more than once in a short period of time will result in shipment being paid for each checkout, however all items will be sent together regardless. I will take the extra payment as a tip.


3. DELAYED/MISSING PACKAGE

  • In the event of a delayed or missing order, bear in mind that once the order has been dispatched, the package is out of my hands and, especially with International orders, there is only so much I can do on my side of things.

  • If your package is delayed or missing, please give a few days for the tracking history to update before taking action. If there is no change, contact your local Post Office. I am open to communicate with the buyer to discuss the order’s receipts and given tracking history to assist in finding the package.

  • If the concern persists, you may have to request a parcel search with your local Post Office.


4. RIGHTS AND USAGE

  • All items included in an order that display my artwork are for the buyer’s personal use only and are not to be re-sold, used for commercial use or other means of direct monetisation towards the buyer or another person.

  • All items included in an order that display my artwork are not to be claimed as created by the buyer or another person.

  • I do not hold any rights to second-hand items that may be listed on the Shop or included in orders and have no say as to how they may be used or redistributed by the buyer.


5. REFUND POLICY

  • You may request a refund and cancellation up to 24 hours after order confirmation. After this time period, I will not accept refunds. Please look over your basket and be confident in your decision before ordering.

  • There are some exceptions to this;

I will take responsibility for replacing/refunding:

  • Orders that have not arrived due to the address on the postal label not matching the address provided by the buyer. This can be the fault of a postal service or myself.

  • Orders that have not been sent out 2 months after order confirmation and have received no update in regards to their delay.

  • Missing items from your order.

I will NOT be responsible for replacing/refunding:

  • Lost packages due to incorrect shipping information provided by the buyer.

  • Orders shipped to the wrong address if an address change was required but not requested.

  • Damaged items during shipment through the postal service (eg. package bent into a mailbox, left in the rain, mishandling by the carrier).

  • Items damaged or lost due to the buyer’s use after they are received.

  • Other situations that result in damage or loss of items that are not due to my own error or otherwise was out of my control.


  • Please provide clear proof or other information of attempts to contact your local Post Office to locate your package that aligns with tracking information. I am open to communicating with the buyer in regards to finding a delayed or missing parcel.
